Terms of Service

Welcome to Komunalac. These Terms of Service ("Terms") govern your use of the Komunalac mobile application ("the App") operated by Open Kinetix doo, a company registered in Kragujevac, Serbia ("we", "us", "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Komunalac is a civic engagement platform that allows users to:

• Report communal and civic issues (potholes, illegal dumping, broken infrastructure, etc.)
• Track the status and resolution of reported issues
• View issues reported by other community members
• Participate in community engagement features (upvoting, verification, gamification)

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

3. User Accounts

3.1 Anonymous Use

You may use the App without creating an account. A unique device identifier will be used to track your reports and activity.

3.2 Registered Accounts

If you create an account, you are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Providing accurate and complete information

4. Acceptable Use

You agree to use the App only for lawful purposes. You must NOT:

4.1 Content Restrictions

• Submit false, misleading, or fraudulent reports
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload content that infringes on intellectual property rights of others
• Upload content containing personal information of others without their consent
• Submit spam or repetitive reports

4.2 Technical Restrictions

• Attempt to gain unauthorized access to the App or its systems
• Use automated scripts, bots, or scrapers to access the App
• Interfere with or disrupt the App's operation
• Reverse engineer, decompile, or disassemble the App

4.3 Misuse

• Use the App to harass, abuse, or harm others
• Impersonate any person or entity
• Use the App for any commercial purpose without our consent
• Manipulate gamification features through fraudulent means

5. User Content

5.1 Ownership

You retain ownership of content you submit (photos, descriptions). However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the App.

5.2 Responsibility

You are solely responsible for the content you submit. We do not endorse or guarantee the accuracy of user-submitted content.

5.3 Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion and without notice.

6. Intellectual Property

The App, including its design, features, code, and content (excluding user-generated content), is owned by Open Kinetix doo and protected by intellectual property laws. "Komunalac" and the Komunalac logo are trademarks of Open Kinetix doo.

7. Disclaimers

We do not guarantee that issues reported through the App will be resolved by local authorities. We facilitate reporting but have no control over the actions of municipal authorities.

8. Limitation of Liability

To the maximum extent permitted by law:

• Open Kinetix doo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claims shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

9. Termination

You may stop using the App at any time by uninstalling it from your device. We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any disputes shall be resolved through the courts of Kragujevac, Serbia.
